Summit Township Agreements

Commercial Public Right-Of-Way / Privately Maintained Road Agreement:

This agreement is required to be entered into with the township when the owner has proposed a development which is to be accessed by a privately maintained road/street that does not meet the established Summit Township specifications for the construction of streets. With this agreement signed by the owner, Summit Township can allow such a development with the mutual understanding that the maintenance responsibility of the road/street will solely belong to the owner and successor grantees of lots abutting the road/street.

Developers Agreement:

This agreement is required to be entered into with the Township by any owner/developer who proposes a land development project within Summit Township. By signing this agreement the owner/developer acknowledges that they will: comply with all Pennsylvania law, applicable Township ordinances, resolutions, codes and terms of the agreement, construct the development at their own cost and expense, deposit an escrow together with an acceptable form of financial security with the Township for all improvements, be bound by the terms in, and memorialize their understanding of, the agreement.

Indemnity Agreement for Application for Highway Occupancy Permit Concerning Subsurface Stormwater Facilities

This agreement is required to be entered into with the Township by any developer who proposes conveyance of subsurface stormwater flows from their own development site into subsurface stormwater drainage facilities located in a highway right-of-way owned by the Pennsylvania Department of Transportation (PennDOT). PennDOT policy requires the Municipality within which the developers project is located to join as a Co-Permittee with the developer for the required Highway Occupancy Permit (HOP). By signing this agreement the developer acknowledges that they shall be solely responsible for constructing, inspecting, maintaining and repairing the subsurface stormwater drainage facilities.

Multiple Listing Directional Sign Agreement:

This agreement is required to be entered into with the Township when an Owner desires to construct and install a multiple listing directional sign at a road intersection of primary and secondary streets and highwayswith Summit Township, authorized under Section 612.10 of the Summit Township Zoning Ordinance. By signing this agreement the Owner agrees to comply with all regulations for signage in the Zoning Ordinance and be solely responsible for the proper construction and maintenance of the sign.

Residential Public Right-Of-Way / Privately Maintained Road Agreement:

This agreement is required to be entered into with the township when the owner has proposed a development which is to be accessed by a privately maintained road/street that does not meet the established Summit Township specifications for the construction of streets. With this agreement signed by the owner, Summit Township can allow such a development with the mutual understanding that the maintenance responsibility of the road/street will solely belong to the owner and successor grantees of lots abutting the road/street. Only a maximum of four (4) dwellings can be constructed, that utilize the private roadway as frontage before Summit Township would require the road to be built to proper public specifications.

Stormwater Operation and Maintenance Agreement:

This agreement is required to be entered into with the Township prior to final approval of a Stormwater Management Site Plan and Report. The purpose of this agreement is to guarantee the satisfactory operation and maintenance of all Best Management Practice (BMP) facilities. A Financial Security which is based upon the projects schedule of values is required to be submitted with this signed agreement. This agreement lists the owner as the sole responsible party for the operation and maintenance of the stormwater BMPs, and clearly states that the municipality has the right to inspect those facilities, and if necessary perform required maintenance services at the owners expense.

Stormwater Review Fee Reimbursement Agreement:

This agreement is required to be completed and signed by the Landowner prior to the submission of any Stormwater Management Site Plan. This agreement authorizes and directs the Summit Township Engineer to review the Landowner’s plans, use their property and make any necessary recommendations with respect to the plans submitted. By signing this agreement the Landowner acknowledges that Summit Township will incur costs and fees relating to the above referenced review by the Summit Township Engineer, and agrees to reimburse Summit Township for such costs.
